3. All Fees are subjected to prevailing Goods and Services tax (hereinafter referred to as “GST”).
4. Interest at the rate of 2% per month will be charged for any amount outstanding from the date of tax invoice until full payment is received.
5. CT Elevator agrees to send a skilled technician at regular intervals in accordance with the existing Government Regulations to check, adjust, clean, grease and oil, if necessary, all the motor equipment and control devices, and will exercise reasonable care to maintain the Equipment in proper and safe condition.
6. The Owner undertakes to notify CT Elevator immediately of any disorder of the operation of the Equipment and CT Elevator agrees to dispatch a technician promptly.
7. Emergency call-back service for lift breakdown with man trap rescue operation shall be provided on a 24-hour basis. However, all preventive routine maintenance and rectification works or major repairs which require more than one hour to complete, shall be performed during CT Elevator normal working hours: Mon to Fri (9:00am to 6:00pm).
8. CT Elevator shall be entitled to charge The Owner for additional services rendered by but not limited to:
1) Retrieve objects fallen into the lift and/or escalator pit
2) Respond to false reporting calls for lift and/or escalator mantrap/breakdowns
3) Respond to false fire alarm/power failure homing etc.
4) Provide technician(s) to support Annual Singapore Civil Defense Force Inspection, Power Shut-down Exercise etc.
9. If CT Elevator, at the Owner's request, shall carry out examination or work outside regular working hour (e.g., Inspections, request for Lift Technician standby etc.), CT Elevator shall be entitled to make an additional charge calculated below: -
1) During office hours:
Monday to Fridays (9.00am to 6.00pm)
Saturdays (9.00am to 2.00pm)
1st 2 hours: S$150 per hour
Subsequent hour: S$50 per hour

2) After office hours:
Monday to Friday (6.00pm to 10pm)
Saturdays (1pm onwards)
1st 2 hours: S$200 per hour
Subsequent hour: S$70 per hour
 
Sundays and Public Holidays (8.30am to 10.00pm)
1st 2 hours: S$300 per hour
Subsequent hour: S$100 per hour

3) Response Time:
i. Man Trapped: Within 30-45 minutes (subject to the situations beyond CT Elevator's control.)
ii. Lift Breakdown: Within 2 hours
iii. 24 Hours Hotline No.: 1800-684-2345 / 9159 5093
10. The Owner agrees to pay all charges on submission of tax invoice(s). Non-payment as aforementioned, or breach of any other term in this Agreement, shall entitle CT Elevator to terminate this Agreement by giving one calendar month notice in writing. Upon such termination, all outstanding amounts due to CT Elevator shall be payable immediately. CT Elevator shall be entitled to take all steps necessary to recover the sums, including but not limited to commencing legal action against The Owner.
11.
CT Elevator's obligation to repair and supply spare parts without extra charge under this Agreement shall be limited to those repairs or replacement necessitated by normal wear and tear. In the event that CT Elevator is of the opinion that it is necessary to carry repairs and replacements caused by negligence or misuse of the Equipment or by reason of any other causes beyond CT Elevator's control, for the purpose of keeping the Equipment in good running order and repair, CT Elevator may carry out such repairs or replacement at The Owner's expense without the prior approval of The Owner, provided the cost of such repairs or replacements does not exceed $500.00. CT Elevator shall thereafter inform The Owner within the next three working days of such necessary repairs or replacements and the defective parts replaced.

CT Elevator's obligation to repair and supply spare parts without extra charge under this Agreement shall be limited to those repairs or replacement necessitated by normal wear and tear. In the event that CT Elevator is of the opinion that it is necessary to carry repairs and replacements caused by negligence or misuse of the Equipment or by reason of any other causes beyond CT Elevator's control, for the purpose of keeping the Equipment in good running order and repair, CT Elevator may carry out such repairs or replacement at The Owner's expense without the prior approval of The Owner, provided the cost of such repairs or replacements does not exceed $500.00. CT Elevator shall thereafter inform The Owner within the next three working days of such necessary repairs or replacements and the defective parts replaced.

In the event that The Owner refuses or fails to authorize CT Elevator to carry out such repairs and/or replacements described aforementioned, CT Elevator shall not be held liable for any loss, damage, injury, or claim of any nature whatsoever, whether arising from or attributable to the failure to carry out such repairs or replacements or otherwise and CT Elevator shall be entitled to terminate this Agreement by giving one calendar month notice in writing.

In carrying out such repairs or replacements, CT Elevator shall be the sole judge of the necessity and suitability of any work performed or parts supplied, and no other parties including insurance companies or Government Authorities shall cause any additions or alterations to be made to the Equipment without CT Elevator's written agreement.
12. CT Elevator will provide the Service of regular maintenance on 20 items in accordance with BCA circular “APPBMSMA-2016-03” circulated on 25 July 2016. The 20 items are listed as below:

13. CT Elevator assumes no responsibility for any repair and spare parts replacements to the Equipment occasioned by or resulting from force majeure, willful or malicious damage or any other cause or event beyond the control of CT Elevator and any work which may be deemed necessary by reason of the change in the existing ordinance and/or regulations and codes which apply to the Equipment coming into force after the date on which the Agreement commencing date. “CT Elevator” will not be responsible for informing the Owner of any such changes.
14. The following replacement, repainting, repairing, reconditioning, refurnishing works are chargeable under this contract:

14) Decorative and Renovation Works, (e.g., Cage Panels, Suspended Ceilings, Floorings etc.),
15) Hoist-way Enclosure, Landing Door Panels, Sills, and Jambs,
16) Card Access Systems, and CCTVs,
17) Supervisory Panels and Computer & Peripherals (e.g., Lift Control and Monitoring System),
18) Pit Equipment (Car & Counterweight Buffers, Spring Buffers, Hydraulic Buffers, Polyurethane Buffers),
19) ARD, EBOPS, UPS System including Batteries,
20) Controller Emergency Brake Release Battery,
21) Lift Travelling Cables
22) Car Door Sensor, Door Operator, Door Cum/Knife & Door Belt

28) Motor and Motor Windings, Rotating Element (Pulleys & Sheaves), Motor Bearings and Speed Encoder/Tachometer, and
29) VVVF Drive, Related Motor Power Drive System.
15. It is expressly agreed that the Owner has absolute possession and control of the Equipment and CT Elevator shall not be liable for any loss, damage or delay due to any cause beyond reasonable control including, but not limited to, acts of Government, burglary, strikes, lockouts, fire, explosion, theft, floods, riot, civil commotion, war, lightning, malicious vandalism or acts of God and under no circumstances shall CT Elevator be held liable for consequential damages or loss of income.15. It is expressly agreed that the Owner has absolute possession and control of the Equipment and CT Elevator shall not be liable for any loss, damage or delay due to any cause beyond reasonable control including, but not limited to, acts of Government, burglary, strikes, lockouts, fire, explosion, theft, floods, riot, civil commotion, war, lightning, malicious vandalism or acts of God and under no circumstances shall CT Elevator be held liable for consequential damages or loss of income.
16. It is further agreed that in carrying out, attempting to carry out or failing to carry out any work or service referred to in this Agreement, CT Elevator shall not be held liable or responsible to The Owner or to any other party for any loss, damage or injury of any nature whatsoever which may be sustained unless proven that such loss, damage or injury was due directly to the negligence of CT Elevator or any of their duly authorized employees. CT Elevator shall not in any event be liable for any consequential loss, loss of profit, loss of use of the building in which the Equipment are installed, or claims of like nature, whether caused by the negligence of their employees or not.
17. The Owner undertakes during the subsistence of this Agreement that they will not allow or permit any person whatsoever (other than duly authorized representatives of CT Elevator) to do any work whatsoever on the Equipment, without the written consent of CT Elevator prior.
18. Nothing in this Agreement shall be construed as an undertaking or warranty by CT Elevator that they are or will at any time hereafter, be able to supply any materials or parts to service, maintain, repair and keep the Equipment in good condition. CT Elevator will supply such materials, components parts and/or assemblies only so far as these are available and necessary for the performance or of their obligations hereunder. Where materials, component parts of assemblies are no longer available due to the obsolescence. The Owner agree that CT Elevator can do upgrading job if cannot find the spare parts out in the market. CT Elevator reserves the right to, at the cost of The Owner, to obtain and use replacement materials, component parts or assemblies (as the case may be) where in the opinion of CT Elevator, such replacements improve the performance of the Equipment.
19. CT Elevator may terminate this Agreement without notice to the Owner if:
1) If the Owner shall not agree to any repairs and/or spare part replacements deemed necessary by CT Elevator for the safe operation of the Equipment; or
2) If the Owner shall become bankrupt or being a corporation, if the Owner shall go into liquidation or have a receiver appointed over all or part of its revenues or assets; or
3) If the Owner is in breach of any of the provisions in this Agreement; or
4) The Maintenance fee is not paid within three (03) months of the due Payment Date
5) 5) Notwithstanding the provisions of the Condition 14 above, if the Maintenance Fee or any other payable amount owing by the Owner to CT Elevator (whether under this Agreement or otherwise) is not paid within three (03) months of the due date for payment CT Elevator may at its discretion, either to suspend or terminate the provisions of the said services until such monies owing by the Owner (including the Maintenance Fee for any such period of suspension) have been paid in full.
6) 6) In the event of termination, CT Elevator will be under no further obligation to provide the services and all monies owing by the Owner under this agreement shall become immediately due and payable.
20. This Agreement sets out the entire agreement between CT Elevator and the Owner as to the maintenance and repair of the Equipment and supersedes and cancels out any and all other contracts, agreements, understandings, and commitments made by CT Elevator and the Owner with respects to the same subject matter.
21. The agreement shall commence on the Commencement Date and will continue for the Period of Agreement specified above (unless terminated) and will continue thereafter on an annual basis unless terminated by either party giving to other not less than three (03) calendar months' notice.
22. This Agreement shall be governed by and construed in accordance with the laws of Singapore.
